official rules

NO PURCHASE NECESSARY.  A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING.

1. Eligibility:  MGD Presents The Craft (the “Contest”) is open only to legal residents of the fifty (50) United States and the District of Columbia (excluding California and Tennessee) who are at least twenty one (21) years old at the time of entry and who did not purchase any equipment for purposes of entering the Contest.  Employees, officers and directors of MySpace, Inc., (“MySpace”), Miller Brewing Company, SABMiller plc., their representatives, affiliates, subsidiaries, advertising and promotional agencies, wholesalers and alcohol beverage retailers, ePrize, LLC and any of their respective parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each are not eligible.  The Contest is subject to all applicable federal, state, and local laws and regulations.  Void in California, Tennessee and where prohibited by law.  

2. Sponsor: Miller Brewing Company, 3939 West Highland Boulevard, Milwaukee, WI 53208.  Administrator: ePrize, LLC, One ePrize Drive, Pleasant Ridge, MI 48069.

3. Agreement to Official Rules: By participating in the Contest, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, MySpace, Inc. and/or Administrator, which are final and binding in all matters related to the Contest.  Whether an entrant receives a prize is contingent upon fulfilling all requirements set forth herein.

4. Timing: The Contest begins on November 29, 2007 at 6:00 p.m. Pacific Time ("PT") and ends on March 31, 2008 at 6:00 p.m. PT (the "Contest Period").  The Contest consists of four (4) phases as set forth in the chart below.

MySpace’s computer is the official time-keeping device for the Contest.

5. How to Enter: During the Submission Phase, visit http://www.myspace.com/thecraftmgd and follow the links and instructions to login and/or create a MySpace account.  Creating a MySpace account is free.  After creating and/or logging into your MySpace account, follow the links and instructions to submit one (1) text essay describing an experience you had enjoying the artistic passion of your favorite musical artist (the “Essay”).  Essays must not exceed two thousand (2,000) characters in length.  By completing the registration and submitting your Essay, you agree that your Essay conforms to the Essay Guidelines and Content Restrictions as defined below (collectively, the “Guidelines and Restrictions”) and that Sponsor, in its sole discretion, may remove your Essay and disqualify you from the Contest if it believes, in its sole discretion, that your Essay fails to conform to the Guidelines and Restrictions. 

Essay Guidelines:  The Essay must meet the following guidelines:

  • The Essay must not exceed two thousand (2,000) characters in length; and,
  • The Essay cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means previously.

Content Restrictions: The Essay must meet the following content restrictions:

  • The Essay must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
  • The Essay must not contain brand names or trademarks;
  • The Essay must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous, or intended to harass;
  • The Essay must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; and,
  • The Essay must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where Essay is created.


For all Essays: By submitting an Essay in this Contest, you grant Sponsor and MySpace an irrevocable license to edit, adapt, publish and/or use in any media, with attribution or compensation to you or your successors or assigns or any other entity, your Essay.  Neither Sponsor, MySpace nor Administrator are responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected, stolen, or postage-due Submissions, which are void and disqualified.  All ownership and property rights, but for the right to publicize the Essay as reserved above, will remain solely with the entrant who initially submitted the Essay.  There is no limit on the number of Essays you can submit during the Submission Phase.

6. Winner Determination:  The Grand Prize winner will determined through the process outlined below.

Judging Phase: During the Judging Phase, qualified judges, selected by Sponsor in its sole discretion, will select from all Essays submitted during the Submission Phase, five (5) potential finalists and five (5) alternate potential finalists based on the following criteria (the “Judging Criteria”):

  • Quality of Essay (33%);
  • Creativity of Essay (33%); and
  • Relevance of Essay to Contest theme (34%).

 

In the case of a tie between two (2) or more Essays for a potential finalist or alternate potential finalist, the Essay with the highest Quality score will be the applicable potential finalist or alternate potential finalist.

Qualification Phase: During the Qualification Phase, potential finalists will be notified by email, mail or phone.  Each potential finalist will be required to execute and return to Administrator, within three (3) days of the date notice or attempted notice is sent, an Affidavit of Eligibility, Liability and Publicity Release (where legally permissible) in order to be deemed a finalist and advance to the Voting Phase (the “Opportunity”).  In the event that a potential finalist cannot be contacted and/or fails to execute and return the Affidavit of Eligibility, Liability and Publicity Release within the required time period, he/she forfeits the Opportunity and an alternate potential finalist will be selected in his/her place. Up to three (3) alternate potential finalists (if time permits) will be selected, after which the Opportunity will go un-filled. 

Voting Phase: During the Voting Phase, finalists who have satisfied the qualification requirements set forth above will be posted in a gallery for public voting on http://www.myspace.com/thecraftmgd.  MySpace members who meet the eligibility requirements set forth in Section 1 will be invited to vote for the finalist they believe submitted the best Essay.  Limit: One (1) vote per day per MySpace account.  The voter who receives the most votes during the Voting Phase will be the potential Grand Prize winner.  In the event of a tie between two (2) or more finalists for the Grand Prize, the finalist who received the highest quality score during the Judging Phase will be the potential Grand Prize winner.

7. Winner Requirements: Following the Voting Phase, the potential Grand Prize winner will be notified by email, mail or phone.  The potential Grand Prize winner will be required to execute and return to Administrator, within ten (10) days of the date notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release (where legally permissible) in order to claim his/her prize.  If a potential winner cannot be contacted, or fails to execute and return the Affidavit of Eligibility, Liability and Publicity Release within the required time period, he/she forfeits the prize.  Failure to comply with the above requirement, return of prize notification or prize as undeliverable or disqualification of the potential winner for any reason will result in forfeiture of prize.  In such event, the finalist whose Essay receives the next highest number of votes during the Voting Phase will be the potential Grand Prize winner.  Only three (3) alternate potential Grand Prize winners will be selected by this process, after which the applicable prize will remain un-awarded.  Acceptance of any prize shall constitute and signify winner’s agreement and consent that Sponsor and/or MySpace may use the winner’s name, city, state, likeness, Essay, and/or prize information in connection with the Contest, throughout the universe, including the Internet, without limitation and without further payment or consideration, except where prohibited by law. 

8. Prize: ONE (1) GRAND PRIZE: A trip for four (4) to winner's choice of concert featuring a The Craft artist (artists include Elvis Costello, Jim James, My Morning Jacket, Patty Griffin, Ben Gibbard, Death Cab for Cutie, Paul Westerberg, Frank Black, The Pixies, Aimee Mann and Ben Kweller).  Package includes roundtrip, coach-class air transportation for four (4) from a major airport near winner’s home (determined by Sponsor in its sole discretion) to a destination within the forty-eight (48) contiguous United States where winner's choice of concert featuring a The Craft artist will be held; two (2) nights accommodations at a hotel of Sponsor’s choice (two single rooms, each double occupancy); and admission for four (4) to a concert of winner’s choice featuring a The Craft artist (seats to be determined by Sponsor in its sole discretion, Sponsor not responsible if concert winner selects is sold out or otherwise un-available, in which event winner will be required to select an alternate concert to attend). Travel must be commenced by July 1, 2008, or prize is forfeited.  Trip must be booked at least twenty-one (21) days prior to departure.  Trip subject to availability and blackout dates.   Travel must be roundtrip.  Sponsor will determine airline and flight itinerary in its sole discretion.  No refund or compensation will be made in the event of the cancellation or delay of any flight.  Travel and accommodations are subject to availability.  Travel is subject to the terms and conditions set forth in this Contest, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract.  All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner.  Travel companions must be twenty-one (21) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner.  Travel companion must execute liability/publicity releases (where legally permissible) prior to issuance of travel documents.  Travel restrictions, conditions and limitations may apply.  If in the judgment of Sponsor air travel is not required due to winner’s proximity to prize location, ground transportation will be substituted for roundtrip air transportation at Sponsor’s sole discretion.  Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates.  Sponsor is not responsible if concert is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Sponsor’s sole discretion.  Approximate Retail Value: $4,999.  Actual value may vary based on airfare fluctuations and distance between departure and destination.  Winner will not receive difference between actual and approximate retail value. MySpace, Inc. reserves the right to approve the prize selections made by the winner.  Prize is non-transferable and no substitution will be made unless Sponsor and/or MySpace, Inc., in their sole discretion, determine otherwise.  No cash equivalent.  MySpace, Inc. and/or Sponsor reserves the right to substitute the prize or a prize component for one of equal or greater value should it become unavailable for any reason.  Winner is responsible for all federal, state and local taxes and fees associated with prize receipt and/or use. 

9.  Publicity:  Except where prohibited, participation in the Contest constitutes the winner’s irrevocable consent and release to Sponsor, MySpace and their agents to use, record, reproduce, publish, display, perform and translate: the name, likeness, voice, quotations, opinions and biographical information of the Finalist/Grand Prize winner, including without limitation any Essay, for promotional purposes in any media, worldwide, without further payment or consideration.
10. Release: By receipt of any prize and/or uploading a Essay in this Contest, entrant agrees to release and hold harmless MySpace, Inc., Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties” or the “Contest Entities”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.

11. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s or MySpace’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion.  Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or those of any other promotion or in an unsportsmanlike or disruptive manner.  Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor and MySpace reserve the right to seek damages from any such person to the fullest extent permitted by law.  Sponsor’s and MySpace’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

12. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize.  Sponsor and MySpace are not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof.  Sponsor, MySpace and Administrator are not responsible for any typographical/other error in entries, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Contest.  Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these official rules.  CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAW.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.  Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's internet service provider and/or e-mail client or for insufficient space in user’s email account to receive e-mail. Sponsor reserves the right to modify the Contest or disqualify entrant if fraud, misconduct or technical failures destroy the security, fairness or integrity of the Contest as determined by Sponsor, in their sole discretion.  Proof of submitting entries will not be deemed to be proof of receipt by Sponsor.  Any use of robotic, automatic, programmed or the like methods of participation will void all such submissions by such methods.  In the event Sponsor is prevented from continuing with the promotion or the integrity and/or feasibility of the promotion is severely undermined by any event beyond Sponsor’s control, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, infection by computer virus, unauthorized intervention, technical failures or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the promotion without any further obligation.  If Sponsor, in its discretion, elects to abbreviate the promotion as a result of a Force Majeure event, a notice will be posted on-line; Sponsor reserves the right, but not the obligation, to award the prize in a random drawing from among all valid and eligible entries received up to the time of such Force Majeure event, providing a sufficient number of entries are received.  In no event will more prizes be awarded than stated in these Official Rules.  

13. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.

14. Entrant's Personal Information: Information collected from entrant is subject to ePrize, LLC’s Privacy Policy (http://www.eprize.com/privacy/privacypolicy.html) and MySpace’s Privacy Policy (http://www.myspace.com/Modules/Common/Pages/Privacy.aspx). By entering the Contest, you grant MySpace permission to share your email address and any other personally identifiable information with the other Contest Entities for the purpose of administration, judging and prize fulfillment.  As a result, you may receive additional email communication or promotions from the Contest Entities as any of their members would.  MySpace, Inc. will not sell, rent, transfer or otherwise disclose your personal data to any third party other than the other Contest Entities and as explicitly described herein.
