1. Sweepstakes Period/Sponsor: The "Get Smart Control or Chaos Sweepstakes" (the "Sweepstakes") begins at 12:00 PM Pacific Time ("PT") on May 12, 2008 and ends at 11:59 AM PT on June 13, 2008 (the "Sweepstakes Period"). The sponsor of this Sweepstakes is MySpace, Inc., 407 North Maple Drive, Beverly Hills, CA 90210 (the "Sweepstakes Sponsor"). Pop2Life, LLC is the administrator of the Sweepstakes ("Sweepstakes Administrator").
2. Eligibility: Sweepstakes is open to legal residents of the 48 contiguous United States who are at least 14 years of age and who are registered users with a MySpace account at time of entry. All entrants must be registered members of the www.myspace.com website and in compliance with MySpace’s Terms & Conditions policy located at http://collect.myspace.com/misc/terms.html?z=1 for valid entry. Employees of Sweepstakes Sponsor, Sweepstakes Administrator, or any organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Sweepstakes ("Sponsoring Parties") together with the immediate family members and those living in the same household of such employees are not eligible to enter or win.
3. How to Enter: To enter, visit http://www.myspace.com during the Sweepstakes Entry Period; log on to your MySpace account; go to the Sweepstakes link at http://www.myspace.com/getsmart (the "Sweepstakes Website"); and follow the on-screen instructions which will require that you (1) add the Get Smart Movie profile as your friend, (2) fill in the required information on the official entry form, (3) accept terms and conditions, (4) submit your entry form ("Entry(ies)"). All 4 steps are necessary to enter. All Entries must be received by 11:59 AM PT on June 13, 2008. In the event of a dispute Entry will be deemed submitted by the individual owner of the MySpace Profile account as provided in the Account Settings of that individual account (the "Entrant"). Entry is limited to one entry per MySpace Profile account. Incomplete, unreadable, or unintelligible entries will be disqualified. Entrant must be the rightful owner of the MySpace Account identified in the Entry as of the date of entry into the Sweepstakes. All information and Entries provided by Entrants become the property of the Sweepstakes Sponsor and will not be acknowledged or returned.
4. Prize: There will be One (1) Grand Prize awarded –A trip for two to Washington D.C. which will include Round trip coach class airfare for two to Washington D.C. from a major commercial airport in the 48 contiguous United States near the winner’s primary residence, as determined by Sponsor (Sponsor reserves the right to substitute ground transportation for airfare is winner lives within 150 miles of Washington D.C.), 2 nights hotel accommodation (one double occupancy room and room tax only), admission for two to the Spy Museum and $250 American Express® Gift Card. All other expenses not mentioned herein, including but not limited to, all ground transportation, food, beverages, additional hotel amenities or fees and gratuities, are the responsibility of winner and traveling companion. Airfare and hotel accommodations subject to availability. Certain blackout dates and material restrictions may apply. Travel must be completed by 06/30/09. Arrangements for the fulfillment of Grand Prize will be made by MySpace, Inc. Taxes, if any, are the responsibility of the winner. An IRS form 1099 will be filed on behalf of the winner for the value of the prize. Approximate value of prize is $4000 depending on date and time of departure.
5. Winner Selection: Winner will be selected in a random drawing held on or about June 16, 2008 from among all eligible Entries received. Odds of winning grand prize are determined by the number of Entries received.
6. Winner Notification: The potential winning Entrant(s) will be subject to verification and the requirements of these Official Rules. Sweepstakes Sponsor will notify winning Entrants by e-mail and/or phone on or about June 16, 2008. The Grand Prize Winner will be required to execute an affidavit of eligibility, and release ("Affidavit"). If a potential winner does not respond to the notification phone call or email which will be sent to the email address on file for the potential winners’ MySpace account and which will be sent three (3) times over a three (3) day period, or if said emails are undeliverable, or if potential Grand Prize winner does not return the executed Affidavit within three (3) days of the date of notification, or if a prize is returned as undeliverable or if an Entry is found to be ineligible, the potential winner will forfeit the applicable prize and the Sweepstakes Sponsor will select an alternative winner. If an eligible potential Grand Prize winner is selected who is a minor (as defined under applicable state law), his or her parent or legal guardian must sign the Affidavit on his or her behalf and will be required to travel with the minor winner as a traveling companion. Travel companion must also sign a release prior to travel and must be 18 years of age or older at the time of travel. Sweepstakes Sponsor reserves the right to disqualify any Entrant for any reason, including without limitation, if that Entrant has not complied with these Official Rules or has interfered, in Sweepstakes Sponsor’s sole opinion, with the proper conduct of this Sweepstakes. By entering this Sweepstakes, unless prohibited by law, each Entrant grants to the Sponsoring Parties the right to use, display, distribute or publish such Entrant’s name, likeness, photograph, voice, address (city and state), biographical information, or to refrain from so doing, in any manner in any and all media, whether now known or hereafter devised, anywhere in the world in perpetuity in connection with this Sweepstakes.
7. General Conditions: Sweepstakes is void outside the 48 Contiguous United States and where prohibited by law. By entering, Entrants (and their parents or legal guardians if Entrants are minors) agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, Entrant’s rights, and obligations, or the rights and obligations of the Sponsor in connection with this Sweepstakes, will be governed by, and construed in accordance with, the laws of the State of California, United States of America, without giving effect to any choice of law or conflict of law rules. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Sweepstakes, including without limitation barring Entrants who do not comply with these Official Rules. By entering, Entrants consent to the jurisdiction and venue of the federal, state, and local courts located in California. By participating, Entrants (and their parents or legal guardians if Entrants are minors) agree to be bound by these Official Rules and the decisions of the Sweepstakes Sponsor and its judges, which shall be final in all respects. By participating in this Sweepstakes and/or by accepting any prize that they may win, Entrants (and their parents or legal guardians if Entrants are minors) agree to release the Sweepstakes Sponsor, Sweepstakes Administrator, and their respective parent, subsidiary and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers; and each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from or in connection with participation in this Sweepstakes and/or acceptance or use or misuse of any awarded Prize. The Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate, garbled or unintelligible entries, communications or documents, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by any prize or resulting from the acceptance, possession or use of such prize, or from participation in the Sweepstakes; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. The Sweepstakes Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes, and reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sweepstakes Sponsor's control, corrupt the administration, security or proper play of the Sweepstakes. The Sweepstakes Sponsor may prohibit any Entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines an Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other participants or the Sweepstakes Sponsor representatives. The Sweepstakes Sponsor reserves the right in its sole discretion to suspend, modify or terminate this Sweepstakes in any manner it deems necessary and reasonable. The Sweepstakes Sponsor shall not be responsible if this Sweepstakes cannot be implemented or if a prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, strikes, governmental action, natural disasters, weather or acts of terrorism. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within California. Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. ENTRANT (AND THEIR PARENTS OR LEGAL GUARDIANS IF ENTRANTS ARE MINORS) HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, THE SWEEPSTAKES SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
8. Privacy Policy: Any personal information supplied by you to MySpace will be subject to MySpace’s privacy policy posted at http://collect.myspace.com/misc/ privacy.html?z=1. Unless prohibited by MySpace’s privacy policy or by law, by entering the Sweepstakes, you grant MySpace permission to share your email address and any other personally identifiable information with Sweepstakes Administrator and any organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Sweepstakes, for the purpose of administration, judging and prize fulfillment. MySpace will not sell, rent, transfer or otherwise disclose your personal data to any third party other than as explicitly described therein.
9. Prize Winner List: For a copy of these Official Rules, (or the name of the winners available after June 30, 2008), mail a self-addressed, stamped envelope to: "Get Smart Control or Chaos Sweepstakes" Winner's List or Rules, Pop2Life, 247 Centre Street, 6th Floor, New York, NY 10013.
