COMPETITION TERMS AND CONDITIONS

The following terms and conditions apply for the “Homebake Fashion Incentive Presented by MySpace, Dazed & Confused and Yen Magazine” competition to be conducted by Domestic Music Concepts PTY LTD (“promoter”) located at PO Box 344 Surry Hills NSW 2010.

  1. Duration
  2. The competition will run from 12.01pm 17 September 2007 until 11.59am November 5 2007.

  3. Method of Entry

  4. Entry is available to Australian residents aged 18 years and over who have a registered business and Australian Business Number (ABN). Entrants must send a brief bio and/or portfolio along with images of their designs to fahion@homebake.com.au

  6. Each entry will be judged on originality and creative. Entries Judged the most creative will win. The promoter reserves the right to disqualify any entrant submitting an entry which, in the opinion of the promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The judges' decision is final and no correspondence will be entered into.

    The judging will take place at Fox Interactive Media located at 83-97 Kippax Street Surry Hills, NSW 2010 on the dates set out below.
    Judging dates:
    11.59am November 5 2007 – Entries close
    November 6 – Judging takes place
    November 7 – Winners notified
    November 12 – Winners announced
    Judges will award 5 winners

  7. Prizes
  8. The prize consists of an opportunity for the winners to exhibit and sell their merchandise via a specially set up area (for example a tent structure), within the Markets area at the 2007 Homebake Festival on Saturday December 8 at The Domain, Royal Botanic Gardens, Sydney City NSW.

  9. Use Of Photos etc
  10. It is a condition of entry that the promoter has the right to publicise the names, characters, likenesses or voices of any contestants for any promotion or matter incidental to the competition.

    The winner may also be required by the promoter to participate in a photo, video and/or film session and acknowledges that the promoter has the right to use such publicity photos, videos and/or films in any medium (including, without limitation, the internet) and in any reasonable manner they see fit, unless that person advises the promoter at the time of entering the competition that he/she wishes to retain his/her anonymity.

    Contestants also acknowledge that their photo may be used for a promotional display at the prize providers’ locations. Contestants consent to their entry to be used for publicity purposes.

  12. All prize winners will be notified by return email on Wednesday November 7 2007.

    If the winner does not reply to the winner email notification within 24 hours, the promoter has the right to contact those entrants judged next in line for the prize. The winner who does not notify within the required time shall forfeit the prize.

  13. All prizes are non transferable, non exchangeable, must be used on the dates specified above (where applicable) and are not redeemable for cash.
  14. The winner will be responsible for any and all taxes incurred in relation to their receipt of the prize(s). Winner/s should seek independent financial advice prior to accepting a prize if this is a concern.
  15. If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, computer virus, mobile phone failure, tampering, fraud or any other causes beyond the control of the promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the participating stations reserve the right, subject to State legislation, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
  16. The promoter will not be responsible or liable if for any reason beyond their reasonable control any element of any prize is not provided. The participating stations may, subject to State Regulations, substitute a different prize of equivalent value in place of any prize referred to in these terms and conditions.
  17. The promoter may, subject to State regulations, terminate this competition at any time at their absolute discretion without liability to any contestant or other person.
  18. In all matters, all decisions of the promoter will be final and cannot be contested. No correspondence or discussions will be entertained.
  19. Obtaining time off work and/or study and/or related activities to participate in this competition will be the sole and absolute responsibility of each contestant.
  20. The promoter reserves the right to exclude any persons from the competition on the ground of their medical condition or history or any reason whatsoever.
  21. The personal information supplied by entrants in entering this competition will be used by the participating partners to conduct the contest and to contact entrants if they are a winner. The information may also become part of a database kept by the participating partners used to let entrants know about special offers from the participating partners and new developments. All entrants may have their details removed from the database at any time by simply contacting the promoter.
