Official Rules

OFFICIAL RULES

 

  1. NO PURCHASE NECESSARY TO ENTER.
  2. The “Get on the Bus with the Love Revolution Tour” Contest (the “Contest”) begins at 3:00:00 PM Pacific Daylight Savings Time (“PST”) on November 13, 2007 and ends at 12:00:00 PM (PST) on November 20, 2007 (“Contest Entry Period”). All contestants agree to be bound by these Official Rules.
  3. Contest is open to members of MySpace.com who are friends of Lenny Kravitz at time of entry and are legal U.S. residents age of 18 and older who reside in or within a one hundred and twenty (120) mile radius of any of the following cities/regions: 1) Boston, MA; 2) Chicago, IL; 3) Denver, CO; 4) Detroit, MI; 5) Los Angeles, CA; 6) Minneapolis, MN; 7) New York City, NY; 8) Philadelphia, PA; and 9) San Francisco, CA. Employees of Capitol Music Group, Virgin Records (collectively the “Sponsors”), MySpace, Inc. (“Host”), Ventura Associates, Inc. (collectively, “Contest Entities”) and their parent companies, agents, artists, affiliates, subsidiaries, retailers, prize donors (if any), advertising and promotion agencies and immediate families (or persons residing in same household) of each are not eligible to enter.  By participating in the Contest, contestants agree to release and hold harmless Sponsor, Host and their respective artists, agencies and all affiliated companies and their employees, officers, directors and shareholders from any and all harm, injury, liability, claims and damages resulting or arising in connection with entering and/or winning the Contest.
  4. How to enter the Contest: If you are an existing member of MySpace.com and a friend of Lenny Kravitz, visit www.myspace.com or www.myspace.com/lennykravitz during the Contest Entry Period and follow all entry instruction to enter the Contest,  including entering a photo from yourself from your MySpace profile and stating in 100 words or less “why you should be part of the “love revolution” promotional bus tour.” Upon submitting your entry, your entry will be entered into the competition for the city/region you indicate on your entry. If you are not a member of MySpace.com, visit www.myspace.com and follow all entry instructions to register for free and create a profile, including uploading your photo(s), and providing your name, address, city, state, zip, email address and phone number on the entry. Upon submitting your entry, your entry will be entered into the competition for the city/region you indicate on your entry. Photo on profile must comply with all photo specifications required by MySpace.com. Limit one entry per person.  Incomplete entries will not be eligible for the judging.
  5. All entries submitted become property of the Sponsors and Lenny Kravitz and will not be returned or acknowledged. By entering the Contest you assign all your rights, title and interest in your entry to the Sponsors and agree to sign any documentation that may be necessary to affect such transfer. Broadcast, posting and/or publication of winning or any non-winning entry is at the sole discretion of the Sponsors. You will not be paid for your entry submission or for granting the Sponsors or Lenny Kravitz the right to promote/distribute/post your entry. Your entry submission may not be acknowledged and will not be received or held “in confidence” and your submission does not create a confidential relationship or obligation of secrecy between you and Lenny Kravitz, the Sponsors, the Host or any of their respective parent companies, affiliates or subsidiaries.
  6. All entries must be the original work of the contestant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity.  If the entry contains any material or elements that are not owned by the contestant and/or which are subject to the rights of third parties, the contestant is responsible for obtaining, prior to submission of the entry, any and all releases and consents necessary to permit the use and exhibition of the entry by Sponsors and Host in the manner set forth in these Official Rules, including, without limitation, name and likeness releases for any person who appears in or is identifiable in the entry (collectively, the “Clearances”). If any person appearing or identifiable in the entry is under the age of majority in his/her state of residence, the signature of a parent or legal guardian is required on each release. The Sponsors reserve the right to request copies of these releases including original signatures from any contestant at any time.  By submitting an entry, contestant warrants and represents that he or she and any persons appearing or identifiable in the entry consent to the submission and use of the entry in the Contest, and to its posting on the Internet in connection with the Contest for public viewing.  The entry must not, in the sole and unfettered judgment of the Sponsors and Host, contain any sexually explicit, disparaging, libelous or other inappropriate content or nudity.  Sponsors reserve the right to disqualify any entry that does not comply with the foregoing.
  7. All entries will be judged by selected personnel from Capitol Music Group and Lenny Kravitz (subject to availability) to determine the top scoring entries per city. The entry with the highest score for each city will be declared the potential Winner (“Winner”) for that city.
  8. All judging will be based on the following equally weighted criteria: 1) creativity; 2) enthusiasm; 3) originality and 4) applicability to theme.  In event of a tie, winner will be determined based on highest score for creativity.  In event of further tie, winner will be determined based on highest score for enthusiasm. In event of further tie, winner will be determined based on highest score for applicability to theme. Judges decisions are final.
  9. Winners will be determined on or about November 26 and will be notified on or about November 29, 2007 via overnight mail, telephone and/or email.  If notified via email, the potential Winners must confirm receipt of Contest notification within forty-eight (48) hours after notification. Potential Winners must be able to receive calls from an unlisted/blocked number. All Winners will be required to complete, sign and return an Affidavit of Eligibility, Assignment and Release of Liability and Publicity (where legally permissible), which must be received within five (5) days from date printed on notification, or Winner is automatically disqualified. In addition, Winners may be required to submit any requested releases prior to being declared a Winner.  If a notification is returned as undeliverable, Winner will be disqualified. The Sponsors reserve the right to investigate any Winner to determine if s/he has been truthful, and to disqualify such contestant if the Official Rules requirements were not met or entry submission was false. In case of disqualification for any reason, the entry with the next highest score for that city will be declared as the alternate Winner. A background check may be conducted on all Winners and their guests.  At the discretion of the Sponsors, a Winner may be disqualified for any of the following: if charged with or convicted of a felony or misdemeanor, is not eligible based on the eligibility requirements set forth above, or if delinquent on a government ordered payment, such as but not limited to: child support, spousal support, alimony, tax payments, etc. In the event it is determined that a Winner has not complied with these Official Rules, or has failed to execute and return any required documents within the specified time period, and/or has made false statements or a prize notification is returned as undeliverable, then such Winner will be disqualified and the contestant with the next highest score for that city may be declared the alternate Winner. Should any Winner make any false statement(s) in any document required by the Sponsors, such winner will be disqualified and required to promptly return his or her corresponding prize. 
  10. Prizes and their corresponding Approximate Retail Values (“ARV”): 10 Grand Prizes (one awarded to each Winner of the Contest): The opportunity for each Winner and one guest to join the Love Revolution Press Tour (“Tour”) in Winner’s city and continue to travel on the road with Lenny Kravitz to the remaining cities (if any) on Tour, plus partake in a photo shoot with Lenny Kravitz that will be featured in an issue of YRB Magazine. Sponsors reserve the right to withdraw the feature in the magazine anytime and without any notice. ARV of each Grand Prize: $4,000 - $7,000, depending on how many cities the Winner and his or her guest travel to and days on the road. Each Winner and his or her guest must board the Tour bus in the city the Winner resides. Actual value of each Grand Prize depends on location of each Winner, airfares and the duration Winner and his or her guest are on the road. If actual value of trip turns out to be less than the stated ARV, then the difference will not be awarded. Travel dates for each Winner is at the sole discretion of the Sponsors.  Location, date and time of photo shoot are at the sole discretion of the Sponsors and will be announced at a later date. Winners and guests must travel on dates specified by the Sponsors or forfeit all rights to the prize. Each prize includes: round trip coach airfare, for winner only, to attend photo shoot, 2-day hotel accommodations, return coach airfare [at end of tour] to closest major airport to winner’s residence for winner and his or her guest, bus accommodations, double occupancy hotel accommodations (at selected cities), and admission to shows remaining on tour (if any). All other transportation, including ground and air transportation, meals, taxes, gratuities, incidentals, service charges or other expenses not specified herein are not included and are the sole responsibility of each Winner and his or her guest. If the winner does not live in a city served by Sponsors’ choice of airline carrier, he or she and guest are responsible for transportation to the nearest airport served such airline carrier. Winners and guests must travel together on the same itinerary including same departure and return dates. If a Winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of Winner's parent or legal guardian who will be responsible for executing and signing any required document on minor’s behalf. Travel arrangements must be made through Sponsors’ agent on a carrier of Sponsors’ choice. Winners and guests must comply with any security procedure or measures imposed by the Sponsors and/or tour coordinator(s) and/or its representatives who reserve its right in its sole discretion to suspend or cancel the participation of any Winner and his or her guest due to non-compliance with any security procedure or inappropriate behavior or misconduct. If the Tour (or portion of the Tour) and/or photo shoot are postponed or canceled, no compensation or substitution will be provided and the Sponsors shall have no further obligation to the Winners other than to supply only the remaining portion of prize. If for any reason whatsoever, a Winner is unable to attend the photo shoot or Tour for any reason whatsoever after all travel arrangements have been made and paid, the Sponsors shall have no further obligation to the Winner. If a Grand Prize is forfeited prior to the Sponsors finalizing and paying for travel, and there is sufficient time to notify an alternate Winner, the prize will be awarded to an alternate Winner. Each Winner and guest are responsible for obtaining the proper travel documentation (e.g., valid photo ID, passport or Visa) prior to travel. Each guest must be 18 years or older and will be required to execute and return a Liability/Publicity Release prior to travel. Prizes are nontransferable and cannot be redeemed for cash. 
  11. Winning constitutes permission (except where prohibited by law) to use each contestant’s name, entry, hometown, likeness, prize won, and photograph (all at Sponsors’ and Host’s discretion) for future advertising and publicity on behalf of the Sponsors and Host without additional compensation.  At the sole discretion of the Sponsors, each Winner agrees to pose for photographs to be arranged by, and paid for by the Sponsors at a date, time and location subject to Sponsors’ discretion.  By accepting prize, each Winner releases and holds harmless the Sponsors, the Host, prize donors (if any), and their respective parent companies, artists, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability, injuries, loss or damage of any kind, including personal injury and death, arising from or in connection with the awarding, receipt, possession, use and/or misuse of any prize. Contest subject to all federal, state and local laws and regulations. Void where prohibited by law. 
  12. By participating in the Contest, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of judges and the Sponsors, which are final and binding in all matters relating to the Contest.  Failure to comply with these Official Rules may result in disqualification from the Contest. The Sponsors reserve the right to permanently disqualify any contestant it believes has intentionally violated these Official Rules.
  13. Sponsors and Host are not responsible for any electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by the Sponsors, Host or presenter on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof or for any injury or damage to a contestant’s or any other person’s computer related to or resulting from downloading and/or uploading Contest materials. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsors or Host which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsors reserve the right to withdraw or cancel the Contest and to determine the Winners from all eligible entries receive prior to withdrawal or cancellation. THE SPONSORS AND HOST RESERVE THE RIGHT IN ITS SOLE AND UNFETTERED DISCRETION TO DISQUALIFY ANY CONTESTANT WHO TAMPERS OR IS SUSPECTED OF TAMPERING WITH THE ENTRY PROCESS. Caution: Any attempt by an contestant to deliberately damage any web site, including but not limited to, the entry/registration site, or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsors and Host reserve the right to seek damages and or other relief from any such contestant to the fullest extent of the law.
  14. Except where prohibited by law, as a condition of participating in this Contest, contestant agrees that (1) any and all disputes and causes of action arising out of or connected with this Contest, or prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the contestant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will contestant be permitted to obtain awards for, and contestant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than contestant's actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and contestant further waives all rights to have damages multiplied or increased.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of contestants and Sponsors in connection with this Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA without regard to New York choice of law rules.
  15. Privacy Policy: Any personal information supplied by you to MySpace will be subject to MySpace’s privacy policy posted at http://collect.myspace.com/misc/privacy.html?z=1. Unless prohibited by MySpace’s privacy policy or by law, by entering the Contest, you grant MySpace permission to share your email address and any other personally identifiable information (collectively, “PII”) with the other Contest Entities for the purpose of administration, judging and prize fulfillment. Any PII shared with Capitol Music Group and Virgin Records will be subject to their privacy policy located at www.virginrecords.com and www.capitolrecords.com. MySpace will not sell, rent, transfer or otherwise disclose your personal data to any third party other than as explicitly described herein.
